Fortunately, federal and state courts that have wrestled with the complex issues present in sexual harassment litigation have identified three steps an organization should take to prevent sexual harassment as well as liability for incidents that may nevertheless occur.

Step 3—Educate the Workforce and Train Supervisors.

Seven Common Accident Causes

Consider this statistic: 80 out of every 100 accidents are the fault of the person involved in the incident. Unsafe Acts cause four times as many accidents & injuries as unsafe conditions.

Accidents occur for many reasons. In most industries people tend to look for “things” to blame when an accident happens, because it’s easier than looking for “root causes,” such as those listed below. Consider the underlying accident causes described. Have you been guilty of any of these attitudes or behaviors? If so, you may have not been injured-but next time you may not be so lucky.

  1. Taking Shortcuts: Every day we make decisions we hope will make the job faster and more efficient. But do time savers ever risk your own safety, or that of other crew members? Short cuts that reduce your safety on the job are not shortcuts, but an increased chance for injury.
  2. Being Over Confident: Confidence is a good thing. Overconfidence is too much of a good thing. “It’ll never happen to me” is an attitude that can lead to improper procedures, tools, or methods in your work. Any of these can lead to an injury.
  3. Starting a Task with Incomplete Instructions: To do the job safely and right the first time you need complete information. Have you ever seen a worker sent to do a job, having been given only a part of the job’s instructions? Don’t be shy about asking for explanations about work procedures and safety precautions. It isn’t dumb to ask questions; it’s dumb not to.
  4. Poor Housekeeping: When clients, managers or safety professionals walk through your work site, housekeeping is an accurate indicator of everyone’s attitude about quality, production and safety. Poor housekeeping creates hazards of all types. A well maintained area sets a standard for others to follow. Good housekeeping involves both pride and safety.
  5. Ignoring Safety Procedures: Purposely failing to observe safety procedures can endanger you and your co-workers. You are being paid to follow the company safety policies-not to make your own rules. Being “casual” about safety can lead to a casualty!
  6. Mental Distractions from Work: Having a bad day at home and worrying about it at work is a hazardous combination. Dropping your ‘mental’ guard can pull your focus away from safe work procedures. You can also be distracted when you’re busy working and a friend comes by to talk while you are trying to work. Don’t become a statistic because you took your eyes off the machine “just for a minute.”
  7. Failure to Pre-Plan the Work: There is a lot of talk today about Job Hazard Analysis. JHA’s are an effective way to figure out the smartest ways to work safely and effectively. Being hasty in starting a task, or not thinking through the process can put you in harms way. Instead, Plan Your Work and then Work Your Plan!

Supervisors Beware – BP Workers Charged with Manslaughter

Two men who worked for BP during the 2010 Gulf oil spill disaster have been charged with manslaughter and a third with lying to federal investigators, according to indictments made public Thursday, hours after BP announced it was paying $4.5 billion in a settlement with the U.S. government over the disaster. A federal indictment unsealed in New Orleans claims BP well site leaders Robert Kaluza and Donald Vidrine acted negligently in their supervision of key safety tests performed on the Deepwater Horizon drilling rig before the explosion killed 11 workers in April 2010. The indictment says Kaluza and Vidrine failed to phone engineers onshore to alert them of problems in the drilling operation.

Physical Changes in Aging Workers

What physical changes occur, in general, as a person ages… and how can this affect their work?

Our bodies change as we age. People reach full physical maturity or development at around the age of 25 years. Then after a period of relative stability, our bodies begin to show signs of aging. Most of these changes are first noticed at ages 40 or 50, but changes can occur (or start) as early as 20 or 25. These changes include:

  • Maximum muscular strength and range of joint movement: In general, people lose 15 to 20% of their strength from the ages of 20 to 60.
  • Cardiovascular and respiratory systems: The ability of the heart, lungs and circulatory system to carry oxygen decreases. Between the age of 30 and 65, the functional breathing capacity can reduce by 40%.
  • Regulation of posture and balance: In general people may find it harder to maintain good posture and balance. When seated or standing still, this may not be a problem. However, accidents that happen because someone loses their balance do happen more often with age.
  • Sleep Regulation: As we age, our body is not able to regulate sleep as well as it used to. How long a person sleeps, and how well they sleep, can additionally be disrupted by changing work hours or by light and noise.
  • Thermoregulation (Body Temperature): Our bodies are less able to maintain internal temperatures as well as less able to adjust to changes in external temperature or due to physical activity. This change means that older workers may find heat or cold more difficult to deal with than when they were younger.
  • Vision: Vision changes with age. We will notice we cannot see or read from certain distances as well as we used to.
  • Auditory (Hearing): Hearing also changes. We may not be able to hear as well at higher frequencies (high pitch sounds). Most often, this change is noticed as the inability to listen to a particular voice or sound in a noisy environment.

Office Environment – Worker Safety & Health

Maintaining a healthy office environment requires attention to chemical hazards, equipment and work station design, physical environment (temperature, humidity, light, noise, ventilation, and space), task design, psychological factors (personal interactions, work pace, job control) and sometimes, chemical or other environmental exposures.

A well-designed office allows each employee to work comfortably without needing to over-reach, sit or stand too long, or use awkward postures (correct ergonomic design). Sometimes, equipment or furniture changes are the best solution to allow employees to work comfortably. On other occasions, the equipment may be satisfactory but the task could be redesigned. For example, studies have shown that those working at computers have less discomfort with short, hourly breaks.

Situations in offices that can lead to injury or illness range from physical hazards (such as cords across walkways, leaving low drawers open, objects falling from overhead) to task-related (speed or repetition, duration, job control, etc.), environmental (chemical or biological sources) or design-related hazards (such as nonadjustable furniture or equipment). Job stress that results when the requirements of the job do not match the capabilities or resources of the worker may also result in illness.

Michigan Work Comp 2013 – New Rules Regarding Independent Contractors

How the work comp law in Michigan is changing in 2013

On and after January 1, 2013, services are employment if the services are performed by an individual whom the Michigan administrative hearing system determines to be in an employer-employee relationship using the 20-factor test announced by the internal revenue service of the United States department of treasury in revenue ruling 87-41.

This is a big change in the law and seems to return us to the days of the economic reality test. It appears that employer control over an individual will now be a major factor in the determination of employment status. This change will hopefully reduce the number of employers who try to game the system.

Risk Management in HR

The risk management process

Risk management is a cycle. That means that it is not something that gets checked off a “to do” list but it is a continuous activity. Having a risk management process means that your organization knows and understands the risks to which you are exposed. It also means that your organization has deliberately evaluated the risks and has strategies in place to remove the risk altogether, reduce the likelihood of the risk happening or minimize harm in the event that something happens.

At a very basic level, risk management focuses you on two fundamental questions:

What can go wrong?

What will we do to prevent the harm from occurring in the first place and in response to the harm or loss if it actually happens?

Effective Safety Committees

Safety committees are a key part of safety in the workplace. They can provide a central focus when they represent all functions or departments to allow the organization to take an overall look at safety requirements and to foresee problems. They can provide a sounding board by being a visible and approachable body for safety or health complaints and suggestions. Finally, they can provide central coordination of safety training activities.

Aging Workers

Are there any specific health and safety concerns related to aging workers?

A few. Most studies say that older workers tend to have fewer accidents, but when an older worker does get injured, their injuries are often more severe. They also may take longer to get better. Plus, the types of injuries can be different. Younger workers tend to get more eye or hand injuries, while older workers who have been working for many years report more back injuries.
